Terms of service
Updated: 10/8/26
These Terms of Service ("Terms") are an agreement between you and Cedar & Stone ("Cedar & Stone," "we," "us," "our"). They cover this website and everything we make available through it — information, tools, products, and services — which these Terms call the Site. Our Privacy Policy and our Refund Policy are both incorporated into these Terms by these references.
Browsing the Site, buying through it, or otherwise using it means you accept these Terms, along with the additional terms, conditions, policies, and notices referenced in them or available by hyperlink. They apply to everyone who uses the Site, including visitors, vendors, customers, merchants, and anyone who contributes content. If you do not accept all of them, you may not access or use the Site.
ARBITRATION NOTICE: PLEASE READ SECTION 15 BELOW CAREFULLY. IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH US AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.
Who may use the Site. Our products are meant to be enjoyed by families and children, but the Site itself — browsing it, purchasing through it, and every other part of it — is not intended for use by children. By accepting these Terms, you represent that you are at least the age of majority in your state of residence.
Changes to these Terms. We may change, modify, add to, or remove any part of these Terms at our sole discretion, at any time. The date of the most recent update appears at the top of this page, and the current version is always available here. Checking periodically for changes is your responsibility, and continuing to use the Site after we post a change indicates your agreement to it. Any new feature or tool we add to the Site is also subject to these Terms.
1. Your Account and Security
1.1 How we handle your information. Our Privacy Policy explains how we collect, use, and disclose information from our users.
1.2 Transmissions over the Internet. By using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that transmissions to or through the Site may be intercepted by others, and you assume the risk of security breaches and every consequence that results from them.
1.3 Your credentials. Notify us immediately at info@cspublishing.com of any unauthorized use of your username or password, or any other breach of security you become aware of involving your use of the Site. You agree to exit from your user account at the end of each session, and you may not use anyone else's account at any time. Cedar & Stone explicitly disclaims liability for any and all losses and damages arising from your failure to comply with this section.
2. Rules for Using the Site
2.1 What you agree not to do. In connection with your use of the Site, you agree that you will not:
- Post harmful or unlawful material. Nothing you post, upload, publish, submit, or transmit may: (a) infringe, misappropriate, or violate anyone else's patent, copyright, trademark, trade secret, moral rights, or other intellectual property, or their rights of publicity or privacy; (b) break any applicable law or regulation, encourage conduct that would, or give rise to civil liability; (c) be fraudulent, false, misleading, or deceptive; (d) be defamatory, obscene, pornographic, vulgar, or offensive, which we judge at our sole discretion; (e) promote discrimination, bigotry, racism, hatred, harassment, or harm toward any individual or group; (f) be violent or threatening, or promote violence or conduct that threatens anyone else; or (g) promote illegal or harmful activities or substances.
- Disrupt or damage the Site. Malicious code of any kind counts here — viruses, Trojan horses, cancel bots, harmful code — as do denial-of-service attacks, flood pings, packet or IP spoofing, forged routing or electronic mail address information, and comparable methods or technology.
- Break the law. No violating any law or regulation, local, state, provincial, national or otherwise, and no violating an order of a court.
- Scrape the Site. No scraping, crawling, or spidering any web page or other service the Site contains.
- Mirror or frame our material. Without our express written consent, you may not display, mirror, or frame the Site or any individual element within it, the Cedar & Stone name, any Cedar & Stone trademark or logo, our other proprietary information, or the layout and design of any page or of any form contained on a page.
- Enter non-public areas. Non-public areas of the Site, Cedar & Stone's computer systems, and the technical delivery systems of Cedar & Stone's providers are off limits — no accessing them, tampering with them, or using them.
- Test our security. No probing, scanning, or testing any Cedar & Stone system or network for vulnerabilities, and no breaching any security or authentication measure.
- Circumvent technical protections. Where Cedar & Stone, any of our providers, or any other third party — another user included — has put a technological measure in place to protect the Site or any of its Content, you may not avoid it, bypass it, remove it, deactivate it, impair it, descramble it, or otherwise circumvent it.
- Reverse engineer our software. No attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Site.
- Help others do any of this. No advocating, encouraging, or assisting any third party in doing anything listed above.
2.2 Conduct that interferes with others. Any conduct by a user that in our discretion restricts or inhibits any other user from using or enjoying the Site is expressly prohibited.
2.3 Monitoring and removal. We may monitor and review all materials users post to the Site or through the Site's features, but we are under no obligation to do so, and we are not responsible for those materials. At any time we may disclose whatever information is necessary to satisfy a law, a regulation, or a government request. We may also edit material, refuse to post it, or remove it, in whole or in part, where in our sole discretion it is objectionable or violates these Terms, our policies, or applicable law. If we believe you are in breach of these Terms or applicable law — or for any other reason — we may impose limits on particular features or restrict your access to part or all of the features or the Site, with no notice, penalty, or liability.
2.4 Changes to the Site. At any time and without notice, Cedar & Stone may: (a) modify, suspend, or terminate the Site or any portion of it, or access to it; (b) modify or change the Site or any portion of it, together with any policies or terms that apply; and (c) interrupt its operation, or the operation of any portion of it, where maintenance, error correction, or other changes make that necessary, whether routine or not.
3. Our Content
3.1 What we own. The Site, and all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, artwork, and computer code in it (collectively, the Content), is owned, controlled, or licensed by or to Cedar & Stone unless we note otherwise. That extends to the design, structure, selection, coordination, expression, arrangement, and overall look and feel of the Content, and it is protected by trade dress, copyright, patent, and trademark laws along with various other intellectual property rights. Without our express prior written consent, and except where these Terms expressly provide otherwise, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way — to any other computer, server, website, or other medium for publication or distribution, or for any commercial enterprise.
3.2 Artificial intelligence. We withhold consent for any Content on the Site to be used, reproduced, or downloaded, in any manner or by any third parties, for the purposes of developing, training, or operating artificial intelligence or other machine learning systems (Artificial Intelligence Purposes), translation services included. Anyone using the Site, including third parties reaching it through automated systems, is prohibited from (i) putting any of the Content to Artificial Intelligence Purposes without first seeking our specific and express permission, and (ii) sub-licensing the Content, or directing others to reproduce or otherwise use it in any manner, for purposes of training artificial intelligence technologies to generate text, audio, or video, again without our specific and express permission. A user or automated system that fails to respect these choices will be considered to have breached these Terms.
3.3 Rights we reserve. Cedar & Stone reserves all rights, title, and interest in and to the Site, including all related intellectual property rights, subject to the limited rights expressly granted under these Terms.
3.4 Trademarks owned by others. Reference to any third party-owned trademarks in these Terms or on the Site is for informational purposes only and is not intended to indicate or imply any affiliation, association, sponsorship, or endorsement by the owners of those trademarks.
4. What You Send Us
4.1 Submissions are not confidential. Anything you provide us regarding the Site, directly or indirectly — posting under a company-designated hashtag on a third-party social media site counts as indirectly — along with any feedback, comments, or suggestions you offer (collectively, Submissions), is neither confidential nor proprietary. Submissions shall be treated as public information and may be shared with others on other sites and platforms, and you submit them in compliance with these Terms.
4.2 Feedback belongs to us. Any Submission amounting to feedback, a comment, or a suggestion (collectively, Feedback) is the sole and exclusive property of Cedar & Stone. You hereby irrevocably assign to us all of your right, title, and interest in and to every piece of such Feedback, and our right to use, communicate, reproduce, publish, display, distribute, and exploit it in any manner we choose is unrestricted, irrevocable, world-wide, and royalty-free.
4.3 Everything else you submit. For every Submission that is not Feedback, you hereby grant Cedar & Stone a license to use it as contemplated in these Terms. That license is irrevocable, worldwide, and perpetual.
4.4 Your promises about Submissions. Do not create, post, store, or share any Submission that violates these Terms — including, without limitation, the restrictions set forth in Section 2 above — or one for which you do not hold all the rights necessary to grant the license described above. You represent and warrant that your Submissions, and our use of such content as permitted by these Terms, will violate no rights of, and cause no injury to, any person or entity. Notwithstanding the generality of the foregoing, you must hold the consent of every individual who appears in any video or photograph you submit to the Site; where such an individual is a child, you must hold the consent of that child's parent or legal guardian.
4.5 We may remove Submissions. Screening, editing, and monitoring Submissions is something we may do but are never obliged to do. We may delete or remove any Submission at any time and for any reason, with notice or without it.
5. Copyright Complaints
We do not permit copyright infringing activities or infringement of intellectual property rights on the Site, and we will remove such content if properly notified that it infringes another's intellectual property rights. If you are a copyright owner or an agent of one, and you believe that content on the Site infringes your copyrights, you may submit a notification under the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest;
- description of the material that you claim is infringing and where it is located on the Site;
- your address, telephone number, and email address;
- statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Reaching our Copyright Agent. Email info@cspublishing.com with "DMCA Notice" in the subject line, or write to Copyright Agent, c/o Cedar & Stone, 4747 Research Forest Dr STE 180, PMB 636, The Woodlands, TX 77381.
Once a notice reaches us, we will investigate and take the material down where that proves necessary. We will tell you what the investigation found.
6. Orders, Fees, and Payment
6.1 Paying for your order. Purchasing our products and services means agreeing to pay the fees that go with them, together with any applicable taxes, fees, and shipping and handling charges. Only valid payment methods acceptable to us may be used to complete a purchase via the Site. You represent and warrant that you are authorized to use the payment method you designate, and you authorize us to charge it for the total amount of your order, applicable taxes, fees, delivery, shipping, and handling charges included.
6.2 Fees are not refundable. Except as expressly set forth in these Terms, all fees are non-cancelable and nonrefundable.
6.3 Prices change. Prices for our products are subject to change without notice.
6.4 Orders we may refuse or limit. We reserve the right to refuse any order you place with us, and we may at our sole discretion limit or cancel the quantities purchased per person, per household, or per order. Those limits may reach orders placed by or under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. Where we change or cancel an order, we may attempt to notify you using the email address, billing address, or phone number provided when the order was made. We also reserve the right to limit or prohibit orders that in our sole judgment appear to be placed by dealers, resellers, or distributors. Quantities of our products and services may be limited, and they are subject to return or exchange only according to our Refund Policy. Any offer for any product or service made via the Site is void where prohibited.
6.5 Where our store is hosted. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform through which we sell our products to you. Shopify and Cedar & Stone are independent parties, and we are not responsible for Shopify's content or privacy practices. Shopify may maintain its own terms of use and privacy policies, and we encourage you to review them whenever you purchase a product through the Site or interact with Shopify's platform.
6.6 Who processes your payment. Cedar & Stone uses third parties not affiliated with us to process payments. Our relationship with each of them is contractual in nature — each is a third-party vendor to Cedar & Stone and is not subject to Cedar & Stone's direction or control — so these relationships are not, and should not be construed as, those of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers, or the like. You agree that the third-party processors are solely responsible for controlling, handling, processing, or fulfilling purchases processed through their systems. Making a purchase through the Site may subject you to a third-party processor's own additional terms of use and privacy policies.
6.7 Keeping your details current. You agree to provide current, complete, and accurate purchase and account information for every purchase made via the Site, and to update your account and other information promptly — your email address and your credit card numbers and expiration dates included — so that we can complete your transactions and reach you as needed.
7. Product Information and Pricing
7.1 Photography and color. We use commercially reasonable efforts to display accurate colors and images of the products that appear on the Site, but monitors vary and we cannot guarantee that yours displays any color accurately. Nor do we warrant that the quality of any products, services, information, or other material you purchase or obtain will meet your expectations, or that errors on the Site will be corrected.
7.2 Errors and omissions. Information on the Site occasionally contains typographical errors, inaccuracies, or omissions — in product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. Where information on the Site or on any related website is inaccurate, we reserve the right to correct the error, inaccuracy, or omission, to change or update the information, or to cancel orders, at any time and without prior notice, including after you have submitted your order.
7.3 No obligation to update. Except as required by law, we undertake no obligation to update, amend, or clarify information on the Site or on any related website, pricing information included. Where an update or refresh date appears on the Site or on any related website, it should not be taken to indicate that all information there has been modified or updated.
8. Text Messages
8.1 What you may receive. We may use your mobile number to text you status updates on your orders and shipping information. You may also receive promotional texts from us based on preferences you indicate. The frequency and number of messages you receive will vary.
8.2 Your consent. Participation in mobile messaging is optional and is not a condition of purchase. By providing your mobile number and opting in to receive these communications, you consent to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, nothing in this section should be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer"). When you opt in, we may send you a message to confirm your signup.
8.3 What you need, and what it costs. You must have a wireless device of your own capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate; check your phone's capabilities for specific text messaging instructions. Message and data rates may apply, and you should consult your mobile service carrier's pricing plan to determine the charges for browsing data and for sending and receiving mobile messages. Under no circumstances will we be responsible for any messaging or wireless charges incurred by you or by a person who has access to your wireless device or telephone number.
8.4 How to stop messages. You can cancel the messaging service at any time — just text STOP. After you send us that message, we may send you a message confirming that you have been unsubscribed. In some cases, you may continue to receive service-related notifications.
9. Links and Social Media
9.1 Linked sites. The Site may contain links to other independent third-party websites (Linked Sites), provided solely as a convenience to our visitors. Linked Sites are not under our control, and Cedar & Stone is not responsible for and does not endorse their content, including any information or materials contained on them.
9.2 Social media. We operate pages on third-party social media networks and display social media icons on our website. Social media providers are unaffiliated with us, and we are not responsible for their content or privacy practices. They maintain their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.
10. Access from Outside the United States
Cedar & Stone and the Site are operated in the United States. Our website can be reached worldwide, but not every feature, product, or service discussed, referenced, provided, or offered through or on the Site is available to all persons or in all geographic locations, or is appropriate or available for use outside the United States. We ship our products only to addresses located in the United States. Reaching the Site from outside the United States is your own initiative, and complying with the local laws that apply to you is your responsibility alone.
11. Suspension and Termination
11.1 Our right to suspend or terminate. Where we determine that you have violated these Terms, or other agreements or guidelines which may be associated with your use of the Site, Cedar & Stone may — in its sole discretion, without prior notice, and to the extent applicable — suspend or terminate your access to the Site and/or block your future access to it. You also agree that any violation by you of these Terms may cause irreparable harm to Cedar & Stone for which monetary damages would be inadequate, and you consent to Cedar & Stone obtaining any injunctive or equitable relief that Cedar & Stone deems necessary or appropriate in such circumstances. These remedies sit alongside any others Cedar & Stone may have at law or in equity.
11.2 Amounts you still owe. On any termination or cancellation of this Agreement, you remain responsible for any fees, costs, or expenses incurred prior to termination of this Agreement. You are additionally responsible for, and agree to pay, any legal fees, court costs, or expenses associated with enforcing the terms of this Agreement, whether upon termination or otherwise.
11.3 What survives. Termination of this Agreement, however it comes about, leaves in force its provisions concerning prohibited activities, proprietary and intellectual property rights (for example, copyrights and trademarks), Submissions, disclaimers, limitation of liability, resolution of disputes, indemnity, and jurisdictional issues.
12. Your Indemnity Obligation
You agree to indemnify and hold Cedar & Stone and its subsidiaries, parent corporation and affiliates, and all of their respective officers, directors, owners, employees, agents, attorneys, licensors, representatives, licensees, and suppliers (collectively, the Cedar & Stone Parties), harmless from any demands, loss, liability, claims due to or arising out of or in connection with (1) your access to or use of the Site; (2) your violation of these Terms or any applicable law, rule or regulation, (3) your violation of any rights of any third party; or (4) any disputes or issues between you and any third party.
13. Disclaimers and Limits on Liability
THE SITE IS PROVIDED "AS IS, AS AVAILABLE" AND "WITH ALL FAULTS." CEDAR & STONE AND ITS SUPPLIERS AND LICENSORS MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SITE. CEDAR & STONE AND ITS SUPPLIERS AND LICENSORS DO NOT REPRESENT OR WARRANT THAT (i) THE USE OF THE SITE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (ii) THE SITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR (iii) THE SITE OR THE SERVER(S) THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SITE MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. CEDAR & STONE IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY CEDAR & STONE AND ITS SUPPLIERS AND LICENSORS.
EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT AND UNDER NO LEGAL THEORY, WHETHER TORT (INCLUDING NEGLIGENCE), CONTRACT OR OTHERWISE, WILL THE CEDAR & STONE PARTIES OR THEIR THIRD-PARTY SUPPLIERS OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, EVEN IF THE CEDAR & STONE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE CEDAR & STONE PARTIES' AGGREGATE LIABILITY TO YOU FOR ANY DAMAGES (DIRECT OR OTHERWISE) OR PENALTIES OR LOSS, REGARDLESS OF THE FORM OF ACTION OR CLAIM, EXCEED $100.00.
THE LIMITATIONS AND EXCLUSIONS SET FORTH IN THE FOREGOING PARAGRAPHS APPLY REGARDLESS OF WHETHER THE LIABILITY IS BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTIES, OR ANY OTHER LEGAL THEORY, AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations in this Section may not apply to you.
14. Governing Law
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by United States federal law and the laws of the State of Texas excluding: (a) its conflicts of law principles; and (b) the United Nations Convention on Contracts for the International Sale of Goods.
15. Dispute Resolution
PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH CEDAR & STONE AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.
Binding Arbitration. You agree that to the fullest extent permitted by law all disputes, claims, suits, or controversies arising out of or in any way connected with these Terms and the use of the Site (collectively, "Disputes"), shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") under the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the AAA, as modified by these Terms. There shall be one arbitrator appointed in accordance with the Rules, and you waive your rights to have any and all Disputes resolved in a court; provided, however, that this agreement to arbitrate does not extend to Disputes in which either party seeks (i) injunctive or other equitable relief for the alleged unlawful use of intellectual property, including, without limitation, copyrights, trademarks, trade names, logos, trade secrets or patents, (ii) the right to pursue enforcement actions through applicable U.S. federal, state, or local agencies where such actions are available, or (iii) injunctive relief in a U.S. court of law. The language of the arbitration shall be English. The arbitration proceedings and decision of the arbitrator shall be kept confidential (and may not be disclosed) by the parties or the arbitrator, except to the extent necessary to compel any award made by the arbitrator.
No Class Arbitrations, Class Actions or Representative Actions. Any Dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action or any other type of representative proceeding. There will be no class arbitration or arbitration in which an individual attempts to resolve a Dispute as a representative of another individual or group of individuals. Further, a Dispute cannot be brought as a class or other type of representative action, whether within or outside of arbitration, or on behalf of any other individual or group of individuals.
Location. The location of the arbitration shall be in Houston, Texas.
Authority of Arbitrator. As limited by the AAA Rules and these Terms, the arbitrator will have (i) the exclusive authority and jurisdiction to make all procedural and substantive decisions regarding a Dispute, including the determination of whether a Dispute is arbitrable, and (ii) the authority to grant any remedy that would otherwise be available in court; provided, however, that the arbitrator does not have the authority to conduct a class arbitration or a representative action, which is prohibited by these Terms, or to award punitive damages or any other damages that are not compensatory. The arbitrator may only conduct an individual arbitration and may not consolidate more than one individual's claims, preside over any type of class or representative proceeding or preside over any proceeding involving more than one individual.
Jurisdiction. To the extent that any lawsuit or court proceeding is permitted under these Terms, to the fullest extent permitted by law you agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located in Harris County, Texas for the purpose of litigating all such disputes. You also waive your rights to a jury trial.
Time Limit for Claims. Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. You agree to the admissibility of computer records and electronic evidence in any dispute herein.
Severability of Dispute Resolution; Arbitration. In the event the provisions in this Dispute Resolution Section are held invalid or unenforceable, then this Dispute Resolution Section, in its entirety, will cease to apply, and the parties will not be obligated to arbitrate any Disputes.
16. General Terms
16.1 Electronic communications. Accessing or using the Site, or sending us email, means you are communicating with us electronically, and you consent to receive communications from us the same way. We will reach you by SMS — including for purposes of user authentication — by email, or through the Site. You agree that every agreement, notice, disclosure, and other communication we provide to you electronically satisfies any legal requirement that such communications be in writing. You may preserve these Terms in written form by printing them for your records, and you waive any other requirement that they be evidenced by a written document.
16.2 Export. Content, any copy or adaptation of it, and any product or service offered on the Site may not be used, exported, or re-exported in violation of applicable laws or regulations, including without limitation United States export laws and regulations.
16.3 Severability. Every provision of these Terms stands on its own, and one that proves unenforceable or invalid leaves the enforceability and validity of the rest unaffected. Where a court of competent jurisdiction holds a provision of these Terms invalid or unenforceable, that provision shall be construed, as nearly as possible, to reflect the intentions behind it, with all other provisions remaining in full force and effect.
16.4 Entire agreement. The entire agreement between you and Cedar & Stone with regard to your use of the Site consists of these Terms, our Privacy Policy and Refund Policy, all of which these references incorporate into them, and any other legal notices published by Cedar & Stone.
16.5 No waiver; no third-party rights. Should Cedar & Stone not insist on or enforce strict performance of these Terms, that shall not be deemed a waiver of any provision, or of any right we have to enforce them. A waiver takes effect only in writing. Except as expressly set forth in these Terms, nothing in them shall be interpreted or construed to confer any rights or remedies on third parties.
16.6 Assignment. Assigning these Terms requires the prior written consent of Cedar & Stone; we may assign them freely. This Agreement is binding on the parties hereto and their respective successors, heirs, and permitted assigns. Any assignment in violation of this section is void.
16.7 Events beyond our control. Where conditions outside its control prevent Cedar & Stone from performing any term or condition of this Agreement, that failure shall not be deemed a breach. Such conditions include but are not limited to acts of God, war, strikes, fires, floods, governmental restrictions, power failures, pandemics, and damage to or destruction of any network facilities or servers.
16.8 Notice for California users. Under California Civil Code Section 1789.3, California website users are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
